1. Agreement to Terms

By accessing and using the services provided by KidsEvent Magic ("we," "our," or "us"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use our services. These Terms of Service constitute a legally binding agreement between you and KidsEvent Magic regarding your use of our children's event organization and entertainment services.

2. Services Description

KidsEvent Magic provides professional children's event planning and entertainment services, including but not limited to interactive shows, competitive games, themed celebrations, creative workshops, adventure experiences, and full event management. All services are subject to availability and may be modified or discontinued at our discretion. We reserve the right to refuse service to anyone for any reason at any time.

3. Booking and Reservations

Event bookings are confirmed upon receipt of a signed service agreement and required deposit payment. All booking requests are subject to availability and confirmation by KidsEvent Magic. We recommend booking at least 4-6 weeks in advance for standard events and 8-12 weeks for large or customized celebrations. Specific event details, including date, time, venue, number of attendees, and selected services, must be confirmed in writing prior to the event date.

4. Payment Terms

A non-refundable deposit of 30% of the total service fee is required to secure your event booking. The remaining balance must be paid in full no later than 7 days prior to the scheduled event date. Payments can be made via bank transfer, credit card, or other approved payment methods. Late payments may result in event cancellation or modification of services. All prices are quoted in Australian Dollars (AUD) and include applicable taxes unless otherwise specified.

5. Cancellation and Rescheduling

Cancellations made more than 30 days prior to the event date will receive a full refund minus the non-refundable deposit. Cancellations made 15-30 days prior will receive a 50% refund of payments made beyond the deposit. Cancellations made less than 15 days prior to the event are non-refundable. Rescheduling requests must be made at least 14 days in advance and are subject to availability. One complimentary rescheduling is permitted; subsequent changes may incur administrative fees.

6. Client Responsibilities

Clients are responsible for providing accurate information regarding the event, including the number of attendees, age range of children, venue details, and any special requirements or dietary restrictions. Clients must ensure the venue is suitable for the planned activities and has necessary facilities (electricity, water, adequate space). Clients are responsible for obtaining any required permits or permissions for the event venue. Any significant changes to event details must be communicated to KidsEvent Magic at least 7 days in advance.

7. Liability and Insurance

KidsEvent Magic maintains comprehensive liability insurance covering our services, equipment, and personnel. However, we are not liable for injuries, accidents, or damages that occur due to factors beyond our reasonable control, including but not limited to venue conditions, attendee behavior, or force majeure events. Parents and guardians are responsible for supervising their children during events. We recommend that venues maintain their own liability insurance and that clients verify coverage details with their venue providers.

8. Safety and Conduct

All activities and entertainment provided by KidsEvent Magic adhere to Australian safety standards and age-appropriate guidelines. Our staff are trained in child safety protocols and emergency procedures. We reserve the right to modify or discontinue activities if safety concerns arise. Clients and attendees must follow all safety instructions provided by our staff. Inappropriate behavior, aggression, or actions that endanger others may result in immediate termination of services without refund.

9. Intellectual Property

All content, materials, branding, and intellectual property associated with KidsEvent Magic services remain our exclusive property. Clients may not reproduce, distribute, or commercially exploit any of our proprietary materials without explicit written permission. Event photography and videography conducted by KidsEvent Magic may be used for promotional purposes unless clients explicitly opt out in writing prior to the event.

10. Force Majeure

KidsEvent Magic shall not be liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather conditions, public health emergencies, government restrictions, labor disputes, or equipment failures. In such cases, we will work with clients to reschedule the event or provide a full refund of payments made, at the client's discretion.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable Australian privacy laws. Client information is used solely for service delivery, communication, and improvement of our offerings. We do not share client information with third parties except as necessary for service provision or as required by law. 12. Modifications to Terms

KidsEvent Magic reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Clients with existing bookings will be notified of significant changes that may affect their events. Continued use of our services after modifications constitutes acceptance of the updated terms. We encourage clients to review these terms periodically to stay informed of any changes.

13. Dispute Resolution

Any disputes arising from these terms or our services shall first be addressed through good faith negotiation between the parties. If resolution cannot be achieved, disputes will be subject to mediation before proceeding to formal legal action. These terms are governed by the laws of South Australia, and any legal proceedings shall be conducted in the appropriate courts of Adelaide, South Australia.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and KidsEvent Magic regarding the use of our services. These terms supersede any prior agreements, communications, or understandings, whether written or oral. Any amendments or modifications must be made in writing and signed by authorized representatives of both parties.
